Introduction

We are a platform for models, photographers, agencies, makeup artists, and other industry professionals within the modeling business. We facilitate communication and transactions between models and prospective clients.

Definitions

"Website": GO-MODELS.COM
"Portal/Platform": Website section (accessible only with valid login credentials) through which registered clients can book a model and/or other service providers for a specific job (see scope of services)
"Model": Model who visits the website or uses our platform. Also referred to as "you" below
"Clients": Agents, agencies, photographers, makeup artists, stylists, and other industry professionals who visit the website or use our platform
"External Clients": Agents, agencies, photographers, makeup artists, stylists, and other industry professionals who make requests to us outside the platform and are looking for models
"Users": Models or clients

Agreement

By clicking on the "Apply Now" or "Apply for Free" or "Activate for Free" button or by using personal activation links, you enter into a legally binding agreement with itellico internet solutions gmbh, Postgasse 19, 1010 Vienna, Austria ("go-models" or "us" or "we"). This agreement includes this user agreement and the privacy policy. Upon receiving your login credentials, you may use our platform within the scope of the services provided.

Access to Services

You declare that you maintain only ONE go-models account, that you have created it with your real name, and that all data provided by you is truthful and up-to-date. You are obliged to keep your data up-to-date on an ongoing basis. If our contractual partner is a legal entity or a partnership, by registering you declare that you are acting on their behalf.

If any of the above conditions do not apply, we reserve the right to terminate this agreement with immediate effect.

Notifications

You authorize us to inform you about our services via the following communication channels: email, phone, and post. We will use the contact information provided by you. You are obligated to keep your data current on the portal.

Rights to Content

You retain the rights to the content (text, images, videos, etc.) that you upload to go-models and only grant us permission to publish this content on the platform and on our operated social media channels and, restricted to the content of your comp card, to send or provide it to external clients. You grant go-models an unrestricted, non-exclusive license to use the content, also beyond the scope of this contractual relationship. To present your content in appropriate formats on the platform and, if necessary, share it on our social media channels, you grant us permission to reproduce, distribute, edit (including translation), publicly display, and make it available online.
Please note that the platform is generally not publicly accessible. Information provided by you, such as age, gender, measurements, etc., will be displayed to clients on the platform. Your last name, phone number, and email address will not be displayed. However, you authorize us to transmit your data to external clients.
You may not publicly disclose content provided to you on the platform that displays other users (no screenshots, prints, photos, etc. of lists, conversations, profiles, details, etc.) or take actions that could negatively affect the functionality of our infrastructure. You are not permitted to upload third-party content unless you can grant go-models the permission described here. You declare that your information (in your profile) is truthful and that your content does not violate any laws or good manners. Your profile will be unlocked immediately after a paid contract is concluded. You will receive access (username and password) to your profile after payment is received. You must keep your login information secure and may not disclose it to third parties. Go-models reserves the right to restrict your use of go-models, block or delete your profile if we have reasonable evidence that you have violated one or more provisions of this agreement. If you know or suspect that someone other than you knows your username and password, you must immediately change your password and notify us at support@go-models.com.

Scope of Services

Our portal offers models and clients (such as agencies, and photographers) the opportunity to establish contacts and, if necessary, enter into a business relationship in a protected area (portal) accessible through login. A contractual relationship for jobs is established between the model and the client. go-models provides the following services FREE OF CHARGE:

• Your profile will be visible to other Users
• You can create and get job inquiries in your area or internationally
• Model search and Model-details
• You can mark Models directly as favourites
• You can create jobs on a TFP (Time-For-Prints) basis
• You can upload up to 30 photos to your profile/photos are automatically optimized for screen display.

Cost: The use is free of charge for clients.

Liability

go-models is not liable for the content, accuracy, and completeness of data transmitted or queried, nor for data that can be accessed through the website and platform. User-generated content is not reviewed by us. This also applies to content and/or documents exchanged between users of the platform. We are not responsible for websites to which we link. If the platform contains links to other websites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of the linked websites or the information you may obtain from them. We have no control over the content of these websites or resources.
You indemnify go-models from any claims by third parties against go-models resulting from a breach of their rights by your publication of content on our platform. You will assume all reasonable costs we incur as a result of a breach of third-party rights, including all reasonable costs of legal defense. The assertion of further damages remains unaffected.
If content that you publish on the platform violates third-party rights, you will ensure at your own expense that this content no longer violates third-party rights or obtain the necessary rights for the use of the content on go-models. We are not responsible for the orders processed between users on the platform, nor are we liable for order-related problems that may arise between users, including violations of agreements concluded between users. All order-related obligations of users are to be defined in the agreement concluded by the users. We are not liable to you for loss of profit, loss of business, business interruption, or lost business opportunities. go-models operates the services with the highest possible care, reliability, and availability. However, go-models does not warrant that these services will be accessible without interruption, that the desired connections can always be established and/or provided, or that stored data will remain available under all circumstances. go-models is only liable for damages that we cause you intentionally or through gross negligence. This does not apply to damages to the person.
If one of our employees comments on your suitability for a particular job or content provided by you on the platform, these comments are to be interpreted as simple personal opinions for which we and/or our employees cannot be held responsible.
You agree and acknowledge that (i) the business relationship between you and clients is that of independent contractors; (ii) we do not offer any insurance services; (iii) we do not offer any legal advice; (iv) we are not responsible for the proper execution of the order and any order-related costs that you may incur, such as travel expenses; (v) you are solely responsible for fulfilling your tax and social security obligations.

You must report the behavior of other users who violate this agreement and/or applicable laws by pressing the "Report Abuse" button on the platform or, if this is not available, by contacting us at support@go-models.com.

Duration/Termination/Cancellation

This agreement is concluded for an indefinite period and can be terminated by you or us at any time in writing by means of an informal declaration.

After the termination of the contract, we are not obliged to continue storing your content. Please secure your content in a timely manner.

After termination of the contract and/or deletion of your data, you lose the right to continue using the services and/or accessing them.

Final Provisions

Statements and information about services or paid memberships on the website, platform, or other advertising materials are solely understood as a description of quality and explicitly not as a guarantee or assurance of a property. All contracts between us and users are subject exclusively to Austrian law. The contract language is German. Versions of this user agreement in other languages or for contractual partners in other countries do not apply to this contractual relationship. Only the current version is valid. If provisions of this agreement are or become ineffective, invalid, or unenforceable, the effectiveness, validity, or enforceability of the remaining provisions shall not be affected. In this case, a provision that achieves as closely as possible the economic result of the ineffective, invalid, or unenforceable provision and which is not ineffective, invalid, or unenforceable shall be deemed to have been agreed upon. All agreements, subsequent amendments, additions, side agreements, etc. require a written form with written confirmation by go-models to be valid. For all disputes arising from or in connection with the business relationship, including the validity of this jurisdiction agreement, the contracting parties agree to the exclusive jurisdiction of the competent court at the registered office of go-models. If you are a consumer within the meaning of the Austrian Consumer Protection Act (KSchG), you may only be sued in the courts of your place of residence or habitual abode, or place of employment. You may not assign, transfer, pledge, encumber, subcontract, or otherwise deal with all or any of your rights or obligations under this agreement without our prior written consent. We may at any time assign, transfer, encumber, subcontract, or otherwise deal with all or any of our rights or obligations under this agreement. We are entitled to change the provisions of this agreement, for example, to take account of a change in the range of services or feedback from our customers. We will inform you about changes to these terms and conditions in due time. Changes that exclusively benefit you can be applied on the day of information about the changes. Changes that do not exclusively benefit you become effective if you do not object to them within four weeks of receiving information about the changes and your right of objection. The objection is considered a termination of the contract as of the next possible termination date.
